Well, I'm onto something!!!!

Decided to pull throttle body for hell of it. Didn't do anything to it really but examine it. Did remove cover to expose gears and sensor. Blew it all out. Reconnected it and voila it let me clear codes. Fired it up and runs fine.
Guessing bad connection or it is going bad. If happens again guess I'm ordering a throttle body.

Interestingly now when I turn on ignition I can hear the throttle butterfly valve move a bit. When I was having all the problems this was not happening.

Yes. Shiv is the one who pointed me in that direction and he was right. Not sure exactly where the fuse is, but had it replaced under warranty and all has been fine since.

I can't imagine why a throttle body would cause this though.. If it comes back more often ill try and replace the tb.

Only happens when I'm braking hard it seems.

So just went out trying the car and I did wot. In 5th around 130mph I started to brake and bam. Yellow brake light and dsc malfunction any ideas besides throttle body, don't think that's the issue here!

Whenever a BMW engine surges like that with those kind of warnings, it's usually an issue with the electric throttle control. Glad you got it figured out.

Yep. Mine would "fix" itself for 2wks maybe each time I would disconnect and reconnect throttle body.
That convinced me it was surely that.

Also I had probably become used to it over time but man does the car drive different since new TB.
Feels like I got a new mod.
Response is so much better and seeing a lot more DSC lights blink during hard acceleration.

For me it was throttle body
Listen closely when you turn ignition on but don't crank
You should hear it moving throttle body and springing back. If you don't that's the issue.
Noticed on mine if it made that sound it would crank fine.
If it didn't it would do this issue Everytime.
